1. Acceptance of Terms
By accessing or using Skolmind (“the Platform”) at skolmind.app, skolmind.my, or skolmind.com, you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the Platform.
2. Description of Service
Skolmind is a multi-school SaaS platform for kindergarten management. The Platform provides tools for student management, attendance tracking, parent communication, fee management, child safety features, and reporting. The Platform consists of a web portal for management and teachers, and mobile applications for parents and teachers.
3. Account Registration
School administrators register on behalf of their kindergarten through a multi-step registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
4. Subscription Plans
The Platform offers three subscription tiers - Starter, Growth, and Pro - each with defined limits for active students, staff accounts, classes, SMS notifications, gallery storage, payment gateways, announcement blasts, and other features. When a school exceeds a plan limit, the system does not block the action by default. Overage charges are applied automatically at the end of the billing month and are capped at 70% of the base plan price. Schools may opt for hard limits instead of automatic overage on a per-resource basis.
5. Payment Terms
Subscriptions are billed monthly or annually. Annual billing provides a discount of approximately 17% (2 months free). Platform invoices are separate from school-to-parent fee collection. The Platform does not process, hold, or touch parent payments - schools use their own payment gateway credentials and keep 100% of parent payments.
6. Free Trial
New schools receive a 30-day free trial on the Starter plan without requiring a credit card. After 30 days, your school reverts to the Free plan. Data is retained indefinitely. No data is deleted on trial expiry. Your school continues on the Free plan with reduced limits.
7. Data Ownership
Kindergartens own their data. The Platform operator does not claim ownership of any student records, financial data, communications, photos, or documents uploaded by schools, teachers, or parents. Data is scoped exclusively to the school that created it. Cross-school data access is architecturally prevented.
8. Acceptable Use
You agree not to:
- Use the Platform for any purpose other than kindergarten management
- Share login credentials with unauthorised persons
- Attempt to access data belonging to other schools
- Upload content that violates applicable laws or regulations
- Reverse engineer, decompile, or attempt to extract the Platform's source code
- Interfere with or disrupt the Platform's infrastructure or other users' access
- Use automated tools to scrape or harvest data from the Platform
9. Child Safety Commitment
Schools using the Platform agree to maintain accurate attendance records and respond to safety escalations promptly. The 3-level attendance escalation system is a core safety feature of the Platform and cannot be disabled. Dismissal records are immutable and cannot be altered after creation.
10. Availability & SLA
We target the following uptime SLAs based on plan tier: 99% for Starter, 99.5% for Growth, and 99.9% for Pro. Scheduled maintenance windows are communicated at least 48 hours in advance. Force majeure events are excluded from SLA calculations. Service credits are available for Pro plan subscribers when SLA targets are not met.
11. Termination
Either party may terminate the subscription at any time. Upon termination, the portal becomes read-only and data is retained for 60 days before permanent deletion. You may request a full data export during this retention period. Annual subscriptions are non-refundable after the 14-day grace period.
12. Limitation of Liability
The Platform is provided “as is” and “as available”. While we strive for reliability and security, we are not liable for indirect, incidental, or consequential damages arising from service interruptions, data loss due to factors beyond our reasonable control, or misuse of the Platform by authorised users. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.
13. Governing Law
These Terms are governed by the applicable laws of the jurisdiction in which Skolmind operates. Any disputes shall be resolved through good faith negotiation, followed by binding arbitration if necessary.
